TOWN OF HUME

A regular meeting of the Hume Town Board, Allegany County, New York was held at the Town of Hume Museum, 10842 Claybed Road, Hume, New York on July 13, 2011.  Supervisor Dennis Ricketts called the meeting to order at 7:00 PM, and led the Pledge of Allegiance to the Flag.

 

Town officials in attendance included: Supervisor Dennis Ricketts; Council members Daniel Miller, Christopher Austin, Bryce Bower, and Gregory McKurth; Historian Rondus Miller; Attorney David Pullen; Water/Sewer Superintendent Dana Potter; Highway Superintendent Kevin Peet; and Clerk Sondra MacEwan.

 

MINUTES

 

Councilman McKurth moved that the minutes of the June 22, 2011 meeting of the Hume Town Board be accepted as presented. Councilman Miller seconded the motion. 5 ayes, 0 noes.

 

DOG CONTROL

 

The Board heard about an incident in which 2 dogs, running at large, attacked and injured goats on Kevin Peet’s Claybed Road farm. The dogs were killed; the goats were treated for their injuries and vaccinated against the threat of rabies. State Police and the Dog Control Officer were called to the scene.

 

Mr. Peet asked the Board to pay the veterinarian fees involved. Because New York State repealed the section of the Animal Control Laws concerning animal damage, there is no longer a fund to reimburse owners for the damage done to their livestock by roaming dogs. Any reimbursement must be directed through Court action.

 

There was lengthy discussion on procedures and liabilities in this case in particular, but also for setting procedures for the future. The Town Justice will be queried for suggestions. Also, the Dog Control Officer will be asked to keep copies of all complaints, and will be advised on Seizure of Dog procedures.

 

MUSEUM

 

Rondus Miller, Town Historian, showed the Board the three books produced by FCS ninth grade students after their research at the Town Museum.

 

Louis White has completed painting the building.

 

Supervisor Ricketts directed the attention of the Board to a letter from Walker & Marshall Insurance listing the improvements advised for the blacktop section behind the Museum Building.

 

Councilman Miller moved that the Town follow the insurance company guidelines and remove one of the basketball hoops and make other repairs and cleanup efforts as suggested. Councilman Austin seconded the motion. 5 ayes, 0 noes.

 

HIGHWAY DEPARTMENT

 

Superintendent Peet attended a meeting about FEMA funding for spring storm damage. If the Town application is accepted, he expects reimbursement of approximately $4000 to $7000.

 

Bulldozer work in Cold Creek has begun. The Town is staying within the strict limits of the permit in the work they are performing.

 

Fillmore Central School contacted the Town about removing gravel in the creek behind the school. The removal is recommended by the Army Corps of Engineers. The Town crews will cooperate.

 

Superintendent Peet advised the Board that the 2001 Sterling truck is in need of repair or consideration for replacement in the next fiscal year.

 

Supervisor Ricketts and the Board suggested that Superintendent Peet investigate trucks with natural gas engines.

 

Work on the River Bypass Channel will be coordinated with Allegany County.

 

SIDEWALKS

 

Councilman Austin moved that a transfer of $24000 be authorized from unallocated funds to SM5410.4 for recent construction on sidewalks. Councilman Miller seconded. 5 ayes, 0 noes.

 

LEGAL TOPICS

 

Attorney Pullen noted that the Dog Control Officer must apply to the Court for a Notice to Seize Dog. Dogs that are unlicensed may be seized if the owner fails to comply with notices to license.

 

The agreement for gravel rights between the Town and Thomas Tomaszewski has been drafted, signed by the Supervisor, and forwarded to Mr. Tomaszewski for his signature.

 

Councilman Austin moved that the Supervisor be authorized to sign Certificates of Good Character for the personnel working with the Summer Recreation program including the Director, Aide, and the two attendants. Councilman McKurth seconded. 5 ayes, 0 noes.

 

Attorney Pullen announced a meeting to discuss land use and the Marcellus Shale drilling issues at 1:00 pm on July 29th. Also on that date: County Legislator’s Clambake.

 

WATER AND SEWER DEPARTMENT

 

Superintendent Potter detailed the ongoing work within his department –

 

CLERK’S ITEMS

 

The Fillmore Hotel has applied for a liquor license.

 

The bill to dedicate a portion of State Route 19 within the Town of Hume to Congressional Medal of Honor Winner Almond Fisher has passed the State Legislature and Senate, and the Governor is expected to sign the bill soon.

 

SUPERVISOR’S AGENDA

 

The Ford 0ne-ton truck was sold at Richard Mason’s auction for $2000.00. The commission for the service was $200.00.

 

Councilman Austin moved that $3103.00 be transferred from unallocated funds to SS8130.200 to cover the flow meter costs. Councilman McKurth seconded the motion. 5 ayes, 0 noes.

 

EXECUTIVE SESSION       

 

Supervisor Ricketts moved that the Board enter Executive Session to discuss ongoing negotiations. Councilman Miller seconded. 5 ayes, 0 noes.

 

The Board entered Executive Session at 8:40 PM and returned to Open Meeting at 9:35 PM.

 

BILLS AND REPORTS

 

Councilman Austin moved that the reports of the Supervisor and Town Clerk be accepted as presented, that Highway Voucher #115 be paid if signed by the claimant, and that all other bills be accepted for payment as presented. Councilman Bower seconded. 5 ayes, 0 noes.

Councilman Austin moved that the meeting be adjourned. Councilman Miller seconded the motion. 5 ayes, 0 noes. Meeting adjourned at 9:38 PM.

 

The next regular meeting of the Hume Town Board will be on August 10, 2011 at 7:00 PM at the Town of Hume Museum.
